How Joseph Duggar’s Attorney Could Have Confession Thrown Out

Counting On and 19 Kids and Counting reality star Joseph Duggar recently appeared in court in Florida for the charges brought against him. After allegedly confessing to what he had done in 2020, Duggar entered a plea of not guilty. Florida law enforcement charged him with lewd and lascivious behavior, molesting a victim under 12, and lewd and lascivious behavior conducted by a person over 18. Since entering a written not guilty plea, many fans are wondering how his attorney could possibly have his initial confession thrown out. What is everyone saying? Can Joseph Duggar’s Attorney Get the Confession Discarded?

Counting On fans have been following Joseph Duggar’s case and discussing it on various social media platforms. Some fans remain shocked that he entered a not guilty plea.  He already allegedly confessed to inappropriate behavior with the then nine-year-old girl. Since he did confess, how can his attorney possibly get that initial confession discarded?

Some fans are speaking out and saying that they believe anyone would be silly not to enter a not-guilty plea. If the confession was under false pretenses, such as Joseph not being aware of who was on the call could be another reason to throw it out. There is even talk that perhaps he will try to say that he said it, but that isn’t what he meant. He could claim it was all taken out of context.

Is There a Way Out for Duggar?

Others say that by entering a not guilty plea, it opens up the possibility of a plea deal, which most believe he should take. The charges he is currently facing hold a minimum of 25 years in prison and could go all the way to life in prison.

After the initial court appearance, Duggar paid the bond and was released.  The judge placed a $600,000 bond on Duggar. Joseph also cannot have contact with the alleged victim. He’s also not allowed any visitation with minors without supervision.

Comments Blew Up Over Not Guilty Plea

Fans on social media are continuing to discuss the case of Joseph Duggar and the charges against him. Here are some of the things they are saying about Joseph’s attorney getting his confession inadmissible in court:

  • “If the person to whom Joseph confessed is or ever was a pastor or served in some kind of pastoral capacity involving the Duggars and Joseph did not know other people were listening to the conversation, then they may attempt to argue that some kind of clergy privilege applies to the statements/confessions.”
  • “Full analysis isn’t possible right now, but he might be able to get it thrown out if he wasn’t read his Miranda rights (I’m assuming they didn’t). This would be a hard sell on the part of his defense attorney, since law enforcement has used this said when someone is drunk or high to get a conviction.”
  • “Yeah I can make some guesses how it’ll go procedurally, but since the issues are so factually reliant and we don’t really know that much about the circumstances or pretext that lead to it I’m not confident one way or another to declare that the confession should or should be seen as a slam dunk. I especially can’t agree with the people saying he should just plead guilty at his first appearance cause he ‘already confessed.’”

It’s hard to know what will come of the case in the future. Joseph has asked for a jury trial. Some think it would be a huge mistake on his part not to accept a plea deal and avoid a trial.
